Criteria for inclusion on Prime Dispute's Panels - Please read before you join our Panels.
1. Admission and Requirements to Panels
1.1 Admission to Prime Dispute Panel is by invitation only or upon a formal request made to Prime Dispute Executive.
1.2 In order to be considered for inclusion on the panels, candidates must satisfy the entry requirements:
(a) minimum 10 years post qualifications experience in a primary profession;
(b) a Fellow designation (Fellow Prime Dispute - FPD) at Prime Dispute;
(c) experience of the specific panel for which you are applying for and evidence of having dealt with 2 or more cases (i.e completed at least two commercial arbitral awards);
(d) evidence of recognition in the market for your involvement and expertise in that industry/sector and location;
(e) evidence of active involvement in dispute avoidance/resolution as either advocate or dispute resolver;
(f) recognised good standing and character within industry.
2. Application Process
2.1 Candidates will be required to send to Prime Dispute:
(a) completed 'Formal Appointment Panel Application' (FAPA2) - Available under the 'Members Area' of the website.
(b) the appropriate application fee.
3. Assessment Process
3.1 Candidates may be required to attend an assessment day.
3.2 References will be contacted at the discretion of Prime Dispute, to establish:
(a) the candidate’s appropriate skills set;
(b) the candidate’s reputation in the market place and to confirm relevant experience as specified on the completed FAPA2.
4. Knowledge and Understanding
4.1 The candidate should :
(a) be able to demonstrate an understanding of involvement;
(b)be able to explain when an involvement becomes a conflict;
(c) be aware of the risks of both real and apparent bias and the steps that could be taken to avoid reasonably foreseeable difficulties;
(d) have the ability to deal effectively with both threshold and subsequent jurisdictional problems and challenges;
(e) be aware of relevant statutes and case law.
5.Managing the Process
5.1 The candidate should have:
(a) the ability to manage the case in a transparent, efficient, cost effective and expedient manner;
(b) sufficient standing, gravitas and flexibility of attitude to manage the process;
(c) the ability to control the process, apply judgemental skills and produce appropriate documentation throughout the process.
6. Identify the Issues and Analytical Reasoning
6.1 the candidate should be able to:
(a) provide concise, clear and logical reasons for a decision;
(b) communicate in a structured, fluent and logical manner.
7. Knowledge and Understanding of Costs
7.1 The candidate should be able to demonstrate knowledge of the principles of deciding (where relevant) costs.
8. Personal Data
8.1 Prime Dispute will retain the candidate's information submitted on the application form for legal or business purposes, subject to Data Protection legislation. For more information please refer to our terms and conditions, user agreement or similar.
9. CPD/Relevant Experience
9.1 CPD is important for keeping up to date with practice and procedures. We may ask you for relevant evidence of CPD activity . This includes the following:
(a) acting as a party representative in third party proceedings ;
(b) acting as a dispute resolver;
(c) attending or presenting at relevant industry events;
(d) attending workshop type events;
(e) undertaking private study including webinars.
10. Application and Fee
10.1 If you wish to make an application, please email [email protected] with your curriculum vitae and covering letter stating the Panel which you would like to join and your specific experience for that panel. Please be careful to only select the relevant Panels that apply to you and your experience or your application may be rejected.
10.2 Before your request is processed, Prime Dispute will require the appropriate non-refundable administrative fee to be submitted.
10.3 An invoice will be sent to you and once payment has been received then the Case Officer will process your request.
10.4 The administration fee for each and every Panel is :
(a) Prime Dispute "FPD" (Fellow Prime Dispute, who joined before 1 August 2018) - No fee
(b) Prime Dispute "FPD" (Fellow Prime Dispute, who joined after 2 August 2018) - £399
(c) all existing and new; "APD" (Advocate Prime Dispute) "MPD" (Member Prime Dispute) members - £599 (only in very exceptional circumstances will you be invited to join the Panels)
10. 5 The processing fee is:
(a) non-refundable;
(b) maybe subject to VAT (Value added Tax) or changes of a similar nature at the prevailing rate.

(c) Adjudication;
(d) Commercial Negotiation;
(e) Dispute Boards;
(f) Early Neutral Evaluation;
(g) Emergency Arbitration;
(h) Expert Witness;
(i) Independent Expert;
(j) Med- Arb;
(k) Mediation;
(l) Online Dispute Resolution;
(m) Specialist Panels.
12. Appeal Procedure
12.1 Prime Dispute has the full discretion, to admit or to refuse the admission of any individual to the panel. Prime Dispute will have regard to, the qualification, experience, and knowledge of the candidate as well as the number of panellists currently on the Panel from the country in which the applicant is resident. Appeals should be made in writing to the Director, within 28 days following receipt of Prime Dispute informing the candidate of the results.
12.2 Candidates whose Appeals are not upheld will have no further right of appeal.
*N.B. Prime Dispute does not guarantee any formal appointments or nominations.
**N.B. Admission to the panel is for a fixed period and subject to membership status (i.e If membership is terminated for whatever reason panel membership is also terminated). Candidates are appointed to FAP (Formal Appointment Panel) at the discretion of Prime Dispute. Prime Dispute reserves the right, in its absolute discretion, to remove any person from the Panel at any time without reasons.
