Read More 6 | The High Court has confirmed that a dispute resolution clause in a subsequent settlement agreement will generally supersede an earlier dispute resolution clause. "What you might hold out be reasonable in your opinion is not automatically binding on the other contracting party. This applies, for example, to a duty to mitigate delays." Read More 8 | Under Section 68 of the Arbitration Act 1996, the English Commercial Court granted a challenge to an arbitral award in Mare Nova Incorporated v. Zhangjiagang Jiushun Ship Engineering Co., Ltd [2025] EWHC 223 (Comm). The Court held that the tribunal's ruling on an issue which had not been raised in the proceedings constituted a serious irregularity. In a dispute centred on state immunity and the enforcement of an arbitral award, the judgment means that GDUK can now enforce an arbitration award against Libyan property located in the UK.
