Read More 12 Key Court Decisions/News | 2024/25 1 | The High Court has confirmed that a dispute resolution clause in a subsequent settlement agreement will generally supersede an earlier dispute resolution clause. Link to the judgement: Destin Trading Inc v Saipem SA [2025] EWHC 668 (Ch). Read More 2 | The UK Privy Council has provided a judgment on the meaning of costs. "What you might hold out be reasonable in your opinion is not automatically binding on the other contracting party. This applies, for example, to a duty to mitigate delays." Read More 3 | Under Section 68 of the Arbitration Act 1996, the English Commercial Court granted a challenge to an arbitral award in Mare Nova Incorporated v. Zhangjiagang Jiushun Ship Engineering Co., Ltd [2025] EWHC 223 (Comm). The Court held that the tribunal's ruling on an issue which had not been raised in the proceedings constituted a serious irregularity. Read More 4 | The long-anticipated reforms to the Arbitration Act 1996 have officially made it into law, with the Arbitration Act 2025 receiving Royal Assent this week. The Arbitration Act 2025 will help attract even more businesses from around the world to invest in the UK. Read More 5 | In 'General Dynamics United Kingdom Ltd v The State of Libya [2025] EWCA Civ 134' the Court of Appeal upheld a decision against the State of Libya in a contract dispute with General Dynamics United Kingdom (GDUK). In a dispute centred on state immunity and the enforcement of an arbitral award, the judgment means that GDUK can now enforce an arbitration award against Libyan property located in the UK. Read More 6 | We recently reported on the High Court judgement in the case of DKH Retail Ltd and ors v City Football Group Ltd [2024] EWHC 3231 - High Court orders compulsory mediation despite defendant objections. Read More 7 | The decision in Friedhelm Eronat v CNPC International (Chad) Limited [2024] EWHC 2880 (Comm), highlights the importance of adhering to the strict deadlines set for appeals under the Arbitration Act 1996. The decision highlights the importance of recognising key dates and acting in good time to avoid time bar issues. Read More 8 | The Civil Procedure (Amendment No 3) Rules 2024, which came into force on 01 October 2024, amended the Civil Procedure Rules (CPR). Whilst the Court has always expected parties to engage with ADR (Alternative Dispute Resolution), it is clear now that the Court can order ADR and failure to comply could see costs sanctions imposed. Read More 9 | The English Commercial Court concluded in Aiteo Estern E & P Company Limited v Shell Western Supply and Trading Limited & Ors [2024] EWHC 1993 (Comm), that there was apparent bias by one of the three members of the Tribunal. Aiteo applied to the Commercial Court under section 68 Arbitration Act 1996 to set aside the awards on the grounds of apparent bias being a serious irregularity that unfairly affected them. Read More 10 | The decision in AZ v BY [2024] EWHC 1847 (Comm) confirmed that, in most cases, the court will not interfere unnecessarily in the interpretation of arbitral awards. Read More 11 | The Privy Council examined, an appeal from the Court of Appeal of the Eastern Caribbean Supreme Court (BVI) in Sian Participation Corporation (In Liquidation) v. Halimeda International Ltd [2024] UKPC 16, which addressed whether a company should be wound up when the debt upon which the winding up application is based is subject to an arbitration agreement and is disputed or the subject of a cross-claim. Read More 12 | The High Court of Justice for England and Wales ordered final charging orders on residential properties owned by the Nigeria High Commission in London in relief of an arbitration award, dismissing arguments that the property was not in commercial use and thus enjoyed state immunity from execution.
