An application for removal of arbitrator dismissed! In rejecting Newcastle United’s attempt to remove an arbitrator on grounds of apparent bias under s.24 Arbitration Act 1996, this judgment provides useful guidance on the legal principles and approach to be applied in such cases. Read More Motacus Constructions Ltd v Paolo Castelli SpA | An interesting read regarding a recent TCC judgment. The judgement confirms the English Courts have jurisdiction to enforce adjudication decisions in cross-border disputes under other governing laws. The construction contract was for a hotel project in London (UK) that was subject to Italian law and with an exclusive jurisdiction clause in favour of the French courts. "In my judgment, there was no need for the British Government to make any declaration in respect of construction contracts under and in accordance with art. 21 of the 2005 Hague Convention because the enforcement of an adjudicator's decision is already permitted by art. 7. For all of these reasons, I hold that an application for summary judgment to enforce an adjudicator's decision is an interim measure of protection within art. 7 of the 2005 Hague Convention. The court is not required to suspend or dismiss these proceedings." UK Supreme Court Cases | 2021
Asda Stores Ltd V Brierley and Ors [2019] EWCA Civ 44 | Interesting read regarding the Court of Appeal decision, which has confirmed that predominantly female retail workers in ASDA stores are legally able to compare their roles to predominantly male workers in the company’s depots. The claimants, working in Asda supermarkets brought equal pay claims against their employer, on the basis of comparisons with the pay of male employees employed at depots as part of Asda’s distribution operation.
