"The UK Court of Appeal recently acknowledged this benefit of arbitrating transnational patent disputes in Nokia Technologies OY v Oneplus Technology (Shenzhen) Co Ltd, [2022] EWCA Civ 947 (11 July 2022). This case involved a complex jurisdictional dispute over Nokia’s assertion of its Standard Essential Patents (SEPs)." Read More Ireland | This recent judgment (Western Excavations and Ground Works Ltd - V - Glenman Corporation Ltd 2022/165 MCA) of the High Court represents a further endorsement of the judiciary to actively support the construction #adjudication process. "This case should be seen as another staging post for assessing the success of the CCA 2013 and its processes. This led to what is probably the first Court Order in this jurisdiction to enforce the Adjudicator’s own costs element of the Decision in addition to the Adjudicator’s decision in relation to the Referral." Read More Fellow Paper | An interesting read, by our Fellow Peter Vinden FPD - A case with big implications for collateral warranties - "The adjudication process and Court of Appeal judgement have brought clarity to the interpretation of section 104(1) of the Housing Grants Construction and Regeneration Act 1996. It emphasises an extension of liability for contractors and consultants, and provides that all end-users with an interest in the quality or future performance of a finished building may well have similar rights to the parties involved with the original construction works when it comes to adjudication." Read More Legal Updates/News Key development | Mandatory mediation is looking increasingly likely in Civil and Commercial claims particularly following the government's blueprint for major reforms to the civil justice system which proposes compulsory #mediation for small claims of £10,000. "The Government is also considering whether a requirement to mediate should be expanded beyond small claims. To achieve this, we would need to refer parties to external mediators outside the court service. As such, we are seeking stakeholders’ views on the right approach to strengthening oversight of external mediators and ensuring that the market is providing high-quality and accountable mediation services outside the court system." The Parliament appended a draft directive to its resolution, giving an indication of the type of regulations that can be anticipated in EU Member States in the medium term. The EU Parliament’s proposals, if implemented, would have a significant impact on third-party funding of EU-seated arbitration claims.
