Read More Dubai | An interesting read - "The Dubai Court of Appeal has recently issued a judgment in real estate appeal no. 13 of 2022 in which it held that, where the parties to an arbitration fail to pay their shares of the advances on arbitration costs and the arbitral centre in turn decides not to proceed with the arbitration, the court has jurisdiction over the dispute." The Court considered the interaction between sections 72(1) and 18 of the #ArbitrationAct1996. Section 72(1) allows a non-participating party to an arbitration to seek a declaration from the English Court as to the lack of jurisdiction of the tribunal, and section 18 of the Act gives the Court the power to appoint a tribunal where there is a failure of the appointment procedure between the parties. In the case of Advance JV & Ors -v- Enisca Ltd [2022] EWHC 1152, the TCC considered the validity and interpretation of a pay less notice which failed to refer to a particular payment application, and which was calamitous to a Part 8 claim.
