Dubai | An interesting read - "The Dubai Court of Appeal has recently issued a judgment in real estate appeal no. 13 of 2022 in which it held that, where the parties to an arbitration fail to pay their shares of the advances on arbitration costs and the arbitral centre in turn decides not to proceed with the arbitration, the court has jurisdiction over the dispute." Judgement | Interesting read regarding parties challenging the jurisdiction of an #ArbitralTribunal. The Court considered the interaction between sections 72(1) and 18 of the #ArbitrationAct1996. Section 72(1) allows a non-participating party to an arbitration to seek a declaration from the English Court as to the lack of jurisdiction of the tribunal, and section 18 of the Act gives the Court the power to appoint a tribunal where there is a failure of the appointment procedure between the parties.  Read More

Judgement | “I do not accept that the time for mediation is past and it seems it would be appropriate that two experts would lock horns and agree as to the best way to remedy the situation,” Judge McCourt said. “I am very strongly of the view that the parties should attempt to arrive at a mediated settlement"...Judge McCourt, adjourning the matter to allow the parties consider the court’s invitation to seek #mediation, said a good mediator’s job is to point out some of the more unpalatable aspects of the situation whether from one side or the other." UK | An interesting read - The judgment is a timely reminder that a failure to adequately issue a pay less notice can lead to an employer, ultimately, paying more. In the case of Advance JV & Ors -v- Enisca Ltd [2022] EWHC 1152, the TCC considered the validity and interpretation of a pay less notice which failed to refer to a particular payment application, and which was calamitous to a Part 8 claim. Construction Act | Interesting read for construction projects in the water sector - A new draft order entitled “The Construction Contracts (England) Exclusion Order 2022” was published by the government, which (if approved) is due to come into force as a statutory instrument on 1 October 2022. The purpose of the draft order is to create a new exclusion from the adjudication and payment provisions in Part II of the Housing Grants, Construction and Regeneration Act 1996 (the “Construction Act”).
