Judgement | Interesting read - Africa Finance Corporation & Ors v Aiteo Eastern E & P Company Ltd [2022] EWHC 768 (Comm) (01 April 2022) - Sir Nigel Teare upheld claims for final anti-suit injunctive relief in support of an arbitration agreement and dismissed the defendant’s applications to challenge jurisdiction and set aside an interim anti-suit injunction. Read More
UK | Interesting read - The English High Court upheld an order dismissing the appellants’ application for a stay of legal proceedings. The Court found that the appellants had taken steps in the proceedings to answer the substantive claims, so could not apply for a stay under s.9(3) of the Arbitration Act 1996 (Act). The Court sets out useful guidance regarding when a party to an arbitration agreement will have lost their right to apply to stay court proceedings in favour of #arbitration and will be found to have elected the court’s jurisdiction.

Judgement | The judgment of Mr Justice Twomey provides valuable insight into the Courts’ developing approach to costs orders and the obligations placed on the Courts by section 169 of the Legal Services Regulation Act 2015 (the “2015 Act”). "At a time when there is a well-publicised shortage of judges and a backlog in the courts’ system, it is even more important that costs orders encourage such efficiency by ensuring that scarce court resources are only used when necessary (i.e. if #mediation or other forms of dispute resolution have failed or are inappropriate) and then only to the extent that is necessary (i.e. by only litigating those issues which are necessary to determine the dispute). Where this is not the case, there are likely to be negative costs consequences for the parties. UK | Interesting read - Steve Ward Services (UK) Ltd v Davies & Davies Associates Ltd [2022] EWCA Civ 153 - The Court of Appeal held that the adjudicator was entitled to payment for fees incurred notwithstanding the fact that he resigned and did not deliver a decision. The court held that, on the construction of the adjudicator’s terms which entitled him to payment of fees absent any bad faith, the adjudicator was entitled to their fee even if their resignation was based on an erroneous view that he lacked jurisdiction to determine the dispute. Read More
