Failing to serve a Request for Arbitration under s14(4) of the Act, with the consequence that the process for the appointment of an arbitrator hadn't validly started, was not considered a failure of procedure for the appointment of an arbitrator. Therefore, s18 of the Act was not engaged and the claim was dismissed. To avoid misspent time and costs, as was the case here it would be appropriate to specify an arbitrator appointment mechanism in the arbitration clause. Read More Legal Square Update UK | Update: Third party funding of international commercial arbitration is permitted in Ireland - The President signed the Courts and Civil Law (Miscellaneous Provisions) Act 2023 into law on 5 July 2023, which amends the Arbitration Act 2010 to permit third-party funding of international commercial arbitration in Ireland. In response to a parliamentary question in September 2022, the Minister explained the rationale behind this limited legislative change, was to promote Ireland as a choice for international commercial legal business under the Ireland for Law initiative. Parties who are funded can now bring actions to enforce awards or seek interim relief in support of international commercial arbitration in the Irish Courts without falling foul of the torts of maintenance and champerty.
