International Arbitration News

UK | The High Court has handed down its detailed 140 page judgment in the case of The Federal Republic of Nigeria v Process & Industrial Developments Limited [2023] EWHC 2638 (Comm). The case concerned the Federal Republic of Nigeria's application under s68 of the Arbitration Act 1996 challenging an arbitration award that was reached following a dispute between the parties. The award was overturned on the grounds that it was obtained by fraud. The case highlights that even where there is a highly competent arbitral tribunal, court intervention can still be required in high value, complex cases and the process can still be exposed to serious corruption in certain situation. This case also emphasises the noteworthiness of parties choosing a seat of arbitration with neutral and rigorous courts willing to overturn awards when appropriate. In addition, the Court observed that this case provides “an opportunity to consider whether the arbitration process, which is of outstanding importance and value in the world, needs further attention where the value involved is so large and where a state is involved.”. To discuss a dispute resolution procedure/clause or this judgement with one of our Fellows' please email [email protected] or Read More

London is the most attractive centre for commercial litigation and international arbitration, outperforming other global dispute resolution hubs such as New York, Singapore and Hong Kong. The report found that the London Commercial Court, remains the go-to choice credit to international companies preferring English law when it comes to doing business. The report also referenced data from the Office of National Statistics that showed UK legal services exports increased by nearly half a billion pounds to £6.6 billion in 2021, further demonstrating the legal sector’s strength. The findings from the 2022/3 research include: (i) "London is the most attractive centre for commercial litigation and international arbitration, particularly in the maritime sector English law governs trillions of pounds in over-the-counter (OTC) derivatives transactions and metals trading; (ii) UK legal services exports increased by almost half a billion to £6.648 billion in 2021 (ONS data)".  Read More
UK | THE KING’S SPEECH 2023 | ARBITRATION BILL – The King’s Speech has confirmed that the Law Commission of England and Wales's recommendations will definitely reach the statute book. The Arbitration Bill implements recommendations from the Law Commission’s review of the Arbitration Act 1996. "It will support arbitration in England, Wales, and Northern Ireland by: (i) Empowering arbitrators to expedite decisions on issues that have no real prospect of success.
