The case concerned the Federal Republic of Nigeria's application under s68 of the Arbitration Act 1996 challenging an arbitration award that was reached following a dispute between the parties. The award was overturned on the grounds that it was obtained by fraud. The case highlights that even where there is a highly competent arbitral tribunal, court intervention can still be required in high value, complex cases and the process can still be exposed to serious corruption in certain situation. This case also emphasises the noteworthiness of parties choosing a seat of arbitration with neutral and rigorous courts willing to overturn awards when appropriate. In addition, the Court observed that this case provides “an opportunity to consider whether the arbitration process, which is of outstanding importance and value in the world, needs further attention where the value involved is so large and where a state is involved.”.
