UK | Legal Square Update - Clarification from the UK Supreme Court on a stay of legal proceedings under Section 9 Arbitration Act 1996. The UK Supreme Court delivered its judgment in Republic of Mozambique v Privinvest Shipbuilding SAL (Holding) and others [2023] UKSC 32. The judgment provides significant guidance on the conditions for a stay of court proceedings brought in respect of a “matter” covered by an arbitration agreement, pursuant to section 9 of the Arbitration Act 1996. To discuss a dispute resolution procedure/clause or this judgement with one of our Fellows' please email [email protected] or Read More

Legal Square Update

UK | Dame Sue Carr becomes, and will be known as, the Lady Chief Justice of England and Wales. As Lady Chief Justice, Dame Sue Carr will be the President of the Courts of England and Wales and Head of the Judiciary of England and Wales. She is the 98th person to hold this historic office and the first woman. This is a historic and important time for progress in the legal profession. It is a proud moment for everyone that works in the justice system. The inauguration of the first lady chief justice is very significant. It shows that although we have a way to go, our profession is moving in the right direction. Women make up more than half the population of the world yet have long been overlooked as a vital talent resource that contributes to economic growth and prosperity. Prime Dispute will ask the questions both of established economies/emerging markets and support industry in recognising the leadership women can provide. Read More
UK | Lady Justice Simler will join the Supreme Court of the United Kingdom as a Justice on 14 November 2023. The Supreme Court acknowledged criticisms over the UK judiciary’s record on diversity as it announced Simler’s appointment. Lady Justice Simler is only the fifth female justice appointed since the UK’s top court was set up in its current form in 2009. The statistics on judicial diversity published, highlight women make up 42 per cent of judges. Lady Justice Simler appointment comes after Dame Sue Carr was sworn in as lady chief justice this month, which we announced earlier this month, as the first woman to take up the role in its 750-year history. The chief justice is the head of the judiciary and president of the courts of England and Wales. Read More
