International Arbitration News

UK | The English Commercial Court rejected an application for an anti-suit injunction ASI, to restrain proceedings brought in breach of an arbitration agreement. The agreement provided for the arbitration to be seated in Paris and the court held that; given French law does not recognise ASIs, it was not appropriate for the English court to intervene in support of the arbitration. The judgement highlights that parties should ensure that arbitrations are seated in England or another jurisdiction that issues ASIs in order to ease the risk that a party may commence parallel proceedings in a state court. By this time there were several different forms of contract which had all developed independently of one another and which had become very weighty and cumbersome, e.g., the 1987 Red Book had up to 72 Clauses, which did not necessarily coincide with the numerous clauses in the other forms." Read More

The Law Commission has published its final report which contains recommendations to reform the Arbitration Act 1996. The final report includes draft legislation. The Report and accompanying draft legislation amending the Arbitration Act will now be considered by Parliament. If approved, the proposed amendments are likely to be enacted into law in late 2023 or 2024. The Law Commission - "We have confined our recommendations to a few major initiatives, and a very small number of minor corrections"... Read More
