The judge dismissed the s68 application, holding that s73 of the Arbitration Act 1996 precluded Radisson from raising its objection to the alleged serious irregularity. Read More Decision | The judgment provides another example of the Irish Courts’ continued support for adjudication and gives useful guidance in relation to an adjudicator’s obligations under the Construction Contracts Act 2013. "An adjudicator does not have a role in cajoling the parties to elaborate or improve upon their cases. The adjudicator was entitled, consistent with fair procedures, to reach a decision on the basis of the materials put before him by the parties. The adjudicator was not obliged to enter into a dialogue with the employer nor to invite the employer to shore up its defence by adducing further evidence. Read More Legal Square Update UK | Update: Third party funding of international commercial arbitration is permitted in Ireland - The President signed the Courts and Civil Law (Miscellaneous Provisions) Act 2023 into law on 5 July 2023, which amends the Arbitration Act 2010 to permit third-party funding of international commercial arbitration in Ireland. In response to a parliamentary question in September 2022, the Minister explained the rationale behind this limited legislative change, was to promote Ireland as a choice for international commercial legal business under the Ireland for Law initiative. Parties who are funded can now bring actions to enforce awards or seek interim relief in support of international commercial arbitration in the Irish Courts without falling foul of the torts of maintenance and champerty. The hotels are not geared to conduct arbitrations efficiently as they could be in a dedicated ADR Centre. Substantial steps have been taken in BVI and the Cayman where they have dedicated ADR centres providing bespoke service to clients around the globe.
