EID 2023 | Eid Mubarak! Eid al-Fitr is the earlier of the two official holidays celebrated within Islam. The religious holiday is celebrated by Muslims worldwide because it marks the end of the month-long dawn-to-sunset fasting of Ramadan. Eid is a day of kindness, blessings, assistance and peace, with a spirit of unity and solidarity. Muslims often prepare for Eid al-Fitr by giving money to charity so that less fortunate families can enjoy the festivities as well. In addition to charity, Muslims are also encouraged to give and seek forgiveness during Eid al-Fitr, and look forward to the opportunity to fast again during Ramadan the following year. EU | The EU Plans To Regulate Third-Party Funding in Litigation and #internationalarbitration - Whilst the European Commission has yet to submit any legislative proposal, the draft Directive marks the first step towards the introduction of a new regulatory framework for third-party funding in the EU - this will have far-reaching implications for third-party funded international arbitrations with an EU connection. UK | Appeal under s.69 of the Arbitration Act 1996 on a point of law - The Commercial Court upheld the implication of a term requiring the inspection of a vessel’s holds without delay into a charterparty. The Court decided that although the arbitral award suggested that it was reasonable to imply the term, which is not a sufficient basis to do so, the award was valid if read in a reasonable and commercial manner. UK | A useful read - The Court of Appeal decision is a pivotal one as it clarifies the scope of the “principle of separability” of #arbitration agreements from the main contracts in which they feature. It is crucial for contractual parties to be aware of this principle, specifically if one of them later seeks to argue that an agreement together with its arbitration provision, is invalid. UN | Uruguay ratifies the United Nations Convention on International Settlement Agreements Resulting from Mediation. Read More
Singapore | An interesting read and support for mediation from the Singapore courts in Maxx Engineering Works Pte Ltd v PQ Builders Pte Ltd [2023] SGHC 71. This marks the first time an order for specific performance of an obligation to mediate has been made. This case is a useful reminder that litigating parties and practitioners should consider how they go about drafting, navigating and managing a tiered dispute resolution clause when confronted with a potential dispute. International | An interesting read - Sainsbury’s bid to halt equal pay claim on a technicality is thrown out by #CourtofAppeal - The retailer argued that the employment tribunal should have rejected the equal pay claims against it because most of the claimants’ names were not listed on early-stage paperwork. The Court of Appeal found that Employment Tribunals should do their best not to put artificial barriers in the way of genuine claims. Read More
