INTERNATIONAL ARBITRATION ROUNDTABLE 2023 | Arbitration remains strong and widely accepted as a means of resolving international commercial disputes. Potentially, no other process offers such efficient, impartial, multilateral and clear business mechanism for complex disputes. View the insights from our FPD International Arbitration Panellists. Please note: The 'INTERNATIONAL ARBITRATION ROUNDTABLE 2023' publication includes 2 CPD points for all Prime Dispute members. Read More INTERNATIONAL MEDIATION ROUNDTABLE | Over the last decade the approach taken by commercial parties towards dispute resolution has changed. While traditional forms of dispute resolution remain popular, commercial parties are increasingly looking to alternative forms of dispute resolution mechanisms to find methods of dispute resolution which better suit their commercial needs and deliver efficient and effective results. But does mediation provide the answer? Read More WOMEN IN INTERNATIONAL LAW & ADR ROUNDTABLE | As the under-representation of senior women within the legal and ADR community remains a critical issue in the field, Prime Dispute fellows discuss the steps the community needs to take to overcome this lack of diversity, the development of the role of women in the profession and future challenges that will be faced by the next generation of female practitioners. Read More EID 2023 | Eid Mubarak! Eid al-Fitr is the earlier of the two official holidays celebrated within Islam. The religious holiday is celebrated by Muslims worldwide because it marks the end of the month-long dawn-to-sunset fasting of Ramadan. Eid is a day of kindness, blessings, assistance and peace, with a spirit of unity and solidarity. Muslims often prepare for Eid al-Fitr by giving money to charity so that less fortunate families can enjoy the festivities as well. In addition to charity, Muslims are also encouraged to give and seek forgiveness during Eid al-Fitr, and look forward to the opportunity to fast again during Ramadan the following year. We are proud of the different cultures and religions we have here at Prime Dispute, both as part of the Executive Team and our UK & International members. Read More UK | Appeal under s.69 of the Arbitration Act 1996 on a point of law - The Commercial Court upheld the implication of a term requiring the inspection of a vessel’s holds without delay into a charterparty. The Court decided that although the arbitral award suggested that it was reasonable to imply the term, which is not a sufficient basis to do so, the award was valid if read in a reasonable and commercial manner. Read More UK | On 27 March 2023, the UK Law Commission published its second consultation paper on its review of the UK Arbitration Act 1996 and is requesting responses on three main issues. Read More UK | A useful read - The Court of Appeal decision is a pivotal one as it clarifies the scope of the “principle of separability” of #arbitration agreements from the main contracts in which they feature. It is crucial for contractual parties to be aware of this principle, specifically if one of them later seeks to argue that an agreement together with its arbitration provision, is invalid.
