UK | The Court of Appeal recently ruled that an #ADR clause in a contract was unenforceable due to lack of clarity. This judgment is a useful reminder for parties to contracts that include a #disputeresolution procedure (DRP) clause, and to members drafting DRP clauses. ​Thought Leaders | The rise of the evaluative #mediator - An interesting read by our Fellow Peter Vinden FPD, on the increasing popularity of evaluative mediation and on selecting the right mediator for your dispute. "There is no doubt in my mind that the popularity of evaluative #mediations is on the rise. Clients respond well to the concept of receiving non-binding evaluations, particularly if a negotiated settlement cannot be achieved. Often, the parties will take up the mediator’s suggested evaluation. But in the end, it is all about giving parties an informed choice. Whether the parties settle before the mediator provides his or her non-binding evaluation, after the evaluation is issued or not at all, is beyond the gift and control of the mediator. UK | The Technology & Construction Court (TCC) has addressed the law on if a party resisting the enforcement of an adjudicator’s decision can obtain an order for set off or withholding on the basis of another adjudicator's decision. In this judgement 'FK Construction Limited v ISG Retail Limited [2023] EWHC 1042 (TCC)' the TCC held that no set off or withholding was applicable and therefore enforced the decision in full. UK | Have your say - King's College London launches the 2023 survey on construction adjudication. Open to all users and stakeholders in #construction adjudication in the #UnitedKingdom to complete the 2023 survey on construction adjudication. "Construction adjudication is the main way in which construction disputes are resolved in the UK. Unlike many other forms of ADR, it is not purely voluntary. There is a statutory right to refer a dispute to the adjudication. This makes it all the more important to have robust, clear and comprehensive data on how the process works to make it even better. Last year’s report led to important developments, such as the Adjudication Pledge. EU | The EU Parliament’s committees for the Internal Market and Liberties and Justice have approved compromise amendments for the draft report on the Artificial Intelligence Act. In their amendments to the Commission’s proposal, MEPs aim to ensure that AI systems are overseen by people, are safe, transparent, traceable, non-discriminatory, and environmentally friendly. The Act is expansive and will govern anyone who provides a product or a service that uses AI. The Act will cover systems that can generate output such as content, predictions, recommendations, or decisions influencing environments. A European Parliament committee voted to strengthen its legislative proposal as it heads toward a plenary vote in June 2023. Final approval is expected by the end of the year, or early 2024 at the latest, followed by a grace period for companies and organisations to implement.
